Hello All,

I have had a complete nightmare the last few months. I have an employment tribunal going through, another meeting in July arranged.

My employer has now wrote to me to say that I have exhausted my full sick pay entitlement which is 6 months full sick pay then 6 months half sick pay.

I went on leave with the stress of all the problems i had in the workplace which has severley aggrivated my RA.

This was in February 2011 they say that they are taking into account my sickness leave entitlement from February 2010.

In my contract of employment it clearly states six months full pay and six months half pay.

All of this I think is to get rid of me before it goes to Hearing......... I am at the end of my tether with everything and feel like giving up.

they have set a final hearing with the head of service and i have occ health appointment on Monday which I had to request as they were trying to avoid it.

Pleeeeeaaaaasssssse can anybody help or provide some advice..............x.x.x.x

Hi Michelle

Sorry to hear the grief you are having to go to to get fair treatment with both employment and benefits..

Not sure what you actually mean with regard to the sick pay .. have you actually had all the sick pay ? have they sent you an SSP1 form to claim ESA? Are they saying you will get no money at all ?
A final hearing for what ? is it a disciplinary hearing ? is it a capability hearing ?

You really do need face to face employment advice , as this is not something that can be guessed at here due to the amount of detail required.
Again call the helpline here , call ACAS ( i see they were helpful last time ) and get an appointment at an advice centre for specialist advice .. or at least someone who can get the complete picture and see the paperwork.

Cant be of any more use other than to say this is the sort of situation that many people will find themselves in (including myself) , and whatever the outcome please tell it on here !
Many of us will have the same issues in getting into work and staying in work , and it might be worth considering writing down what has happened firstly to get it straight in your head , and secondly it could act as anecdotal evidence of what pressures people with RA are under with regard benefits and staying in work .( Not to mention the attitudes of employers )

Seriously consider emailing Jamie at NRAS with your whole story , as this will be a huge issue for many and will be powerful evidence on both benefit issues and employment issues.
Above all look after yourself and get the help you need .

Sounds really tough.

I have been through similar when I was still teaching- my employer put me through medicals and all sorts. Normally that only happens after 26wks off I had had 4wks for the entire year.
My Union successfully threatened them with a harassment suit.

I am so sorry that you are having such a tough time with your employer.

Rich has given you some great advice.

The company I work for counts sick leave on a rolling 12 months basis not on an annual basis. Therefore if you were off sick in February this year, they will count the number of days sickness taken since February 2010.

You must, must get some professional help with this and document everything as evidence.

As you say all this worry is not going to do your RA any good.

Poor you, gosh what a dreadful thing to have to put up on top of having to deal with RA.

My Company also have a sickness leave for a rolling 12 months. I was in similar circumstances
to you as I had also used my 13 weeks full pay and 13 weeks 75%, but then through access
to work started back very part time. So even that was 6 months ago I still only do 12 hrs p.w.
as I know that I now could not do the stress of a full time insurance manager.

Rich as always is great, my heart goes out to you, look after yourself and I hope that the
NRAS have been able to help you

My heart really goes out to you over this. I've been having ongoing problems myself for a couple of years and I suspect that the head is trying to get rid of me- he's tried several things and I guess that it will only be a matter of time before he goes down the absence route,even though I've ony had a few days off this working year. He will probably count all the days off since I was diagnosed!!!!

It makes me so angry that we are treated like this- especially when we have been hard working and given our all to our jobs. We don't take time off for trivial reasons. We've done nothing wrong, just been unfortunate to get this b.... disease. We all want to be fine and be able to work to the best of our ability.A bit of support and consideration would go a long way.

Sorry abou the rant but it really gets my back up.

I hope you have a restful weekend.

It has been a struggle and I was so glad to go back to work after being absent when first diagnosed then will everything else its been tough mentally and physically.

I have occupational health appointment tomorrow so i will just be honest and say exactly whats happened and where I am at now...

Empathy goes out to you.

I am facing Absence Review meetings too presently. Thank God I have a Union rep, however, this doesn't stop the permanent nagging in the back of my head as I know my employers want me off my job. I have been told this. Talk about support of the maximum kind .......NOT.


I have lost alot of confidence in myself and my ability, which I resent a great deal.

You 'Go Girl' fight your cause, if you can.

Thanks for that Tracy

I just returned home from my OHU visit. It went quiet well, I just told exactly what happened and all of the stress has made me worse.

She said that she will make her recommendations, and I will get to see the report 2 days before it goes to my employer, and if anything is missed out she will amend.

Pleased that the visit went ok, hope she does a good job with the recommendations. Stress definitely makes RA worse. Ive been off sick for 8 weeks and have been put on half pay like you I think they wish I would just leave quietly! Fingers crossed for you and good luck Tracy with your visit.. Keep fighting!! Good to hear you had a positive visit. Fingers crossed (Well- as much as I canRazz ) that things will be sorted out for you soon. It rally is a pain having to deal with all this emotional pressure as well as the physical side of RA.

Hi Michelle,

Happy weekend to everyone.

I had my Occ Health apt on weds, I was quite emotional before I went, nearly broke down at work.


The meeting went well, she was pretty cross about the lack of support and pressure I am under. I will rec the report 2 days before my employer for approval.

She was impressed with my level of sick days and she recognised that I am doing everything I possible can to continue to be fit for work. I have no life outside of work and home at the moment. I work, rest......but no play!!!! lol

2 weeks till summer hols, can't wait, need to recharge my batteries and some......
